I. General Terms and Conditions
§ 1 Basic Provisions

The following terms and conditions apply to all contracts concluded between you and us (Johan von Ilten GmbH) via the website https://johanvonilten.de. Unless otherwise agreed, your own terms and conditions are not applicable.

A “consumer” within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An “entrepreneur” is any natural or legal person or legally capable partnership acting in the course of a commercial or self-employed activity when concluding a legal transaction.
§ 2 Conclusion of the Contract

The subject of the contract is the sale of goods.

By placing the respective product on our website, we provide a binding offer to conclude a purchase contract under the terms specified in the product description via the online shopping cart system.

The contract is concluded via the online shopping cart system as follows:

The goods you intend to purchase are placed in the "shopping cart".

You can access and modify the cart at any time via the corresponding button.

After clicking the “Checkout” or “Proceed to Order” button and entering personal data and shipping/payment preferences, a final order summary is shown.
If you use an instant payment method (e.g. PayPal Express/Plus/Checkout, Amazon Pay, Sofort, giropay), you may be directed to the payment provider’s site before or after seeing the order summary.
Before submitting the order, you have the option to review, modify, or cancel the order.
By clicking the order button (e.g. “Order with obligation to pay,” “Buy now,” “Pay now,” or similar), you legally accept our offer, and the contract becomes binding.

Inquiries to create a personal offer are non-binding. We will send you a binding offer in text form (e.g. via email), which you can accept within 5 days unless otherwise stated.

Order processing and all related communication are handled by email—some automatically. You must ensure that the email address provided is correct and that email delivery is technically possible (e.g. not blocked by spam filters).
§ 3 Term and Termination for Subscription Contracts

The subscription contract between you and us runs for the period stated in the respective offer (“initial term”). The initial term may not exceed 2 years.

If not terminated by either party at least one month before the end of the initial term, the contract renews automatically for an indefinite period.
The renewed contract can be terminated at any time with one month's notice.

The right to terminate without notice for good cause remains unaffected.

Termination must be in text form (e.g. email) or via the cancellation button on our website (e.g. “Cancel contract here”).
§ 4 Special Terms for Payment Methods

PayPal / PayPal Checkout
If you select a payment method processed through PayPal / PayPal Checkout, the transaction is handled by PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
All available PayPal options will be shown during checkout. PayPal may use other payment services—if special conditions apply, you’ll be informed.

§ 5 Right of Retention, Title Retention

You may only exercise a right of retention if it arises from the same contractual relationship.

The goods remain our property until payment is made in full.
§ 6 Warranty

Statutory warranty rights apply.

Consumers are encouraged to check the goods immediately upon delivery and to report any missing items, visible defects, or transport damage to us and the carrier as soon as possible. Not doing so does not affect your legal warranty rights.

If any feature of the goods deviates from objective requirements, it is only deemed agreed upon if you were explicitly informed before contract conclusion and the deviation was mutually agreed upon.
§ 7 Governing Law, Jurisdiction, Place of Performance

German law applies. For consumers, this applies only to the extent that it does not restrict protections granted under the law of the consumer’s habitual residence.

For business customers, the place of performance and jurisdiction is our registered office. The same applies if you have no general place of jurisdiction in Germany or the EU, or your location is unknown at the time of legal action. This does not affect the right to bring action at any other statutory place of jurisdiction.

The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Language and Storage of the Contract
3.1. The contract language is German.
3.2. The full contract text is not stored by us. You can print or save the contract data before placing the order using your browser. After completing your order, you will receive the legal contract information and terms by email.
3.3. For custom offers (not using the online cart), all contract data will be sent to you in text form, e.g., by email.

Prices and Payment Conditions
6.1. Prices include all applicable taxes.
6.2. Shipping costs are not included in the item prices unless otherwise stated. These are listed separately during checkout.
6.3. Deliveries outside the EU may incur additional charges (e.g. customs duties, transfer fees).
6.4. If you are paying from outside the EU for delivery within the EU, your bank may charge transfer fees.
6.5. Available payment methods are shown on the website or in the offer.
6.6. Unless stated otherwise, all payments are due immediately upon contract conclusion.

Delivery Terms
7.1. Delivery conditions, times, and restrictions are detailed on the website or in the offer.
7.2. For consumers, the risk of loss or damage passes to you upon delivery. If you assign a carrier not chosen by us, the risk transfers upon handover to that carrier.
